    SPOKANE, Wash. – A judge has refused to grant a divorce to a pregnant woman trying to leave her husband two years after he was jailed for beating her, ruling instead that she must wait until the child is born.

    Shawnna Hughes’ husband was convicted of abuse in 2002. She separated from him after the attack and filed for divorce last April. She later became pregnant by another man and is due in March.

    Her husband, Carlos, never contested the divorce, and the court commissioner approved it in October. But the divorce papers failed to note that Hughes was pregnant, and when the judge found out, he rescinded the divorce.

    “There’s a lot of case law that says it is important in this state that children not be illegitimized,” Superior Court Judge Paul Bastine told The Spokesman-Review newspaper on Thursday.

    Hughes’ attorney, Terri Sloyer, said nothing in state law says a pregnant woman cannot get a divorce.

    “We don’t live in 15th-century England,” said Sloyer, who has appealed.

    Under Washington state law, a husband is presumed to be the father of any child born within 300 days of a divorce. The judge argued that the paternity of the child needs to be determined before a divorce can be finalized.

    Hughes has stated in court records that her boyfriend is the child’s father, and that the judge’s decision prevented her from marrying him.

    “She has the right to divorce and be free to marry whoever she wants,” Sloyer said. “It’s about the choice, the fundamental right to choose.”

    I saw that this happened in Spokane and had to post it. WTF?!? She wants to divorce her abusive husband, who is in jail because of abusive acts he committed on her, and the judge won’t allow the divorce because he finds out she’s pregnant! with another man’s baby! And now she can’t get married to her baby’s father. I’m embarrased that this happened in Spokane. I know it seems like there are a buch of rednecks living there- and they have thier fair share of them- but, really, the town is not as bad as this article would make it seem. Still…I am shocked that this happened… What was that judge thinking?!?

    We are staying in tonight. It’s still rainy and stormy outside. Plus we are not party people. We ordered pizza and are watching a few movies.

    I’ve been thinking about my resolutions for next year. I’ve decided that next year I will not use my credit cards, and I will pay off my credit card debt. I’ve also decided to read more. Since I started knitting my reading time has been eaten into. I think I want to dedicate at least a half an hour a day to reading. Also, like Dianne, I want to eat heathier. This is my resolution every year, I swear. Last year I did pretty good. I joined WW on Jan 2nd and lost about 20 pounds doing that. I stopped WW in March and the old habits came back and ten pounds creeped back up. I really want to change my eating habits this year and change them forever. So I will be working on that.

    Reflections on this past year….Well, there have been some really good things that have happened to me personally. I got my first professional job as a librarian. I took up knitting and fell in love with the fiber arts. I met some really cool people via the whole blogging thing. ( also ran into some really awful people, too).

    Unfortunately, 2004 has been a not so good year for me, though. I have ended this year feeling really disillusioned with the world. The election left me feeling lost. It knocked the wind out of me and I haven’t really recovered completely. The Iraq war blazes on and the needless death continues.

    And now there is the unconscionable death and destruction from the Asian Tsunamis. We will be well into 2005 before we truly comprehend the full devastation.

    Personally, 2004 could have been better in many ways, as well. Because of my political disagreements, I have become estranged from my sister. It’s a long, sordid story and one that I would rather just forget. But, well, there it is. Also, right before Christmas, I found out that a good friend of mine at work has just been diagnosed with lukemia. She has spent the holidays in the hospital undergoing intensive chemotherapy treatments. I’ve spent the holidays really worried about her.

    I’m not writing this to be a total downer. I’m writing this so that I can look back on Jan 31 next year and be happy that 2005 was a better year than 2004. I will certainly try to make it better. I am hopeful that it will be.

    I took this picture while on our walk at Pogonip the other day. I love the old Oak trees in this park. They have this old, ancient, gnarled feel to them.

    We had a break from the torrential rain and went for a little walk to the beach. I wanted to get a picture of the rather large waves at Seabright. In the background is the Wharf, and Westside Santa Cruz. The rain started again not long after I took this picture. We are getting hammered with storms. I just walked outside for a second to the laundry room and got totally drenched!
